This article draws on Foucault's concept of governmentality to explore how recent political moves to legalise ‘flexibility’ mobilises education authorities to make ‘community’ a technical means of achieving the political objective of schooling the child. I argue that ‘flexibility’ in this sense is a neo‐liberal strategy that shifts relations between the governed and the State. In this way, it transforms the idea of schooling from a State run institution for the purpose of ‘community building’ to a community run institution for (...) the purpose of making parents governable by both instrumentalising and institutionalising individualism through the force of community membership. Rather than a form of liberation from bureaucratic rule, the paper exposes how ‘flexibility’ acts as a normalising strategy that works with difference to entangle parents as community members in the process of schooling the child through the moral obligation of the contract. Approaches to model evaluation in terms of Occam's razor or principles of parsimony cannot avoid judgements about the relative importance of aspects of the models. Assumptions about “core processing” are usually considered more important than those related to decision components, but when the decision is related to a central feature of the processing, it becomes extremely difficult to tease apart the influences of core and decision components and to draw sensible conclusions about underlying architecture. Student engagement and making community happen is a policy manoeuvre that shapes the political subjectivity of the undergraduate student In Australia, making community happen as a practice of student engagement is described as one of the major challenges for policy and practice in research-led universities. Current efforts to meet this challenge, however, merely recode ethical citizenship to a different but nonetheless prescriptive code of conduct,which closes down thoughts of making community happen to a single unified mode of being by appealing (...) to a normalising practice authorised by expert knowledge. In contrast to this position, we use data gathered from undergraduate students’ observations of their university experience, which appeals to an ethico-politics that opens up the question of making community happen to non-normalising practices.Rather than a will to govern that shuts down debate, student discourse opens up thoughts of making community happen to new contestations and diversity over self-government in relation to others concerning questions of lifestyle choices and friendships. In this way,we argue that making community happen as a practice of student engagement is never fully actualised.While this challenge to the limits of student engagement and making community happen may be seen as a threat to our political existence, it is, nevertheless, a risk worth taking in the interest of student learning. Andrew Wayne discusses some recent attempts to account, within a Bayesian framework, for the "common methodological adage" that "diverse evidence better confirms a hypothesis than does the same amount of similar evidence". One of the approaches considered by Wayne is that suggested by Howson and Urbach and dubbed the "correlation approach" by Wayne. This approach is, indeed, incomplete, in that it neglects the role of the hypothesis under consideration in determining what diversity in a body of evidence (...) is relevant diversity. In this paper, it is shown how this gap can be filled, resulting in a more satisfactory account of the evidential role of diversity of evidence. In addition, it is argued that Wayne's criticism of the correlation approach does not indicate a serious flaw in the approach. (shrink)

Research on corporate social responsibility (CSR) has tended to focus on external stakeholders and outcomes, revealing little about internal effects that might also help explain CSR-firm performance linkages and the impact that corporate marketing strategies can have on internal stakeholders such as employees. The two studies ( N = 1,116 and N = 2,422) presented in this article draw on theory from both corporate marketing and organizational behavior (OB) disciplines to test the general proposition that employee trust partially mediates the (...) relationship between CSR and employee attitudinal and behavioral outcomes. Both studies provide evidence in support of these general relationships. Theoretical and practical implications of these findings are discussed in the context of CSR and corporate marketing research. We report on an interview-based study of decision-making capacity in two classes of patients suffering from depression. Developing a method of second-person hermeneutic phenomenology, we articulate the distinctive combination of temporal agility and temporal inability characteristic of the experience of severely depressed patients. We argue that a cluster of decision-specific temporal abilities is a critical element of decision-making capacity, and we show that loss of these abilities is a risk factor distinguishing severely depressed patients from mildly/moderately depressed patients. We use the format of a hypothetical case study to review issues related to pharmaceutical product approval and physician prescribing practices. In this case, a new FDA-approved drug is recommended for a patient who subsequently experiences an adverse event that may or may not be related to the prescription. This case raises a number of ethical and legal considerations physicians routinely face when deciding whether to recommend such drugs for their patients. Despite the need for ongoing observation by the regulatory (...) apparatus, physicians should be cognizant of the limitations of the drug approval system and the post-approval prescription drug surveillance system. We discuss physicians’ ethical obligations when faced with a newly approved drug, including seeking out independent sources of learning, reporting adverse effects, and notifying patients about limitations in available knowledge about therapeutic recommendations. According to Jules Coleman, Rational Choice Theory holds that human action is both intentional and rational. “The rationality of intentional action is evaluated along the two dimensions corresponding to the two elements of the belief-desire model.” On the belief-dimension, RC Theory assumes that people are “able to draw appropriate inferences from the information they possess.”.

Assessment of decision-making capacity (DMC) can be difficult in acquired brain injury (ABI) particularly with the syndrome of organic personality disorder (OPD) (the “frontal lobe syndrome”). Clinical neuroscience may help but there are challenges translating its constructs to the decision-making abilities considered relevant by law and ethics. An in-depth interview study of DMC in OPD was undertaken. Six patients were purposefully sampled and rich interview data were acquired for scrutiny using interpretative phenomenological analysis. Interview data revealed that awareness of deficit (...) and thinking about psychological states can be present. However, the awareness of deficit may not be “online” and effectively integrated into decision-making. Without this online awareness of deficit the ability to appreciate or use and weigh information in the process of deciding some matters appeared absent. We argue that the decision-making abilities discussed are: (1) necessary for DMC, (2) threatened by ABI, and (3) assessable at interview. Some advice for practically incorporating these abilities within assessments of DMC in patients with OPD is outlined. (shrink)

Landauer’s principle is, roughly, the principle that logically irreversible operations cannot be performed without dissipation of energy, with a specified lower bound on that dissipation. Although widely accepted in the literature on the thermodynamics of computation, it has been the subject of considerable dispute in the philosophical literature. Proofs of the principle have been questioned on the grounds of insufficient generality and on the grounds of the assumption, used in the proofs, of the availability of reversible processes at the microscale. The relevance of the principle, should it be true, has also been questioned, as it has been argued that microscale fluctuations entail dissipation that always greatly exceeds the Landauer bound. In this article Landauer’s principle is treated within statistical mechanics, and a proof of the principle is given that neither relies on neglect of fluctuations nor assumes the availability of thermodynamically reversible processes. In addition, it is argued that microscale fluctuations are no obstacle to approximating thermodynamic reversibility, in the appropriate sense, as closely as one would like. (shrink)

Smokers and nonsmokers possess equal rights but those rights conflict with each other in the use of shared facilities. Medical research has established that smoking harms not only those who use the product but also those who are passively exposed to it. Laws and private regulation of smoking in shared facilities have resulted in the segregation of smokers from nonsmokers to an outright ban of tobacco use. Such controls have provided unsatisfactory results to both groups. An acceptable ethical solution, based (...) on reduction of harm and compensation, can be derived by applying Moral Audit principles, supported by economic analysis, which does not unduly curtail the rights of both parties as to the use of tobacco products. ABSTRACTTime-consciousness has long been a focus of research in phenomenology and phenomenological psychology. We advance and extend this tradition of research by focusing on the character of temporal experience under conditions of mania. Symptom scales and diagnostic criteria for mania are peppered with temporally inflected language: increased rate of speech, racing thoughts, flight-of-ideas, hyperactivity. But what is the underlying structure of temporal experience in manic episodes? We tackle this question using a strategically hybrid approach. We recover and reconstruct three hypotheses (...) regarding manic temporality that were advanced and modeled by two pioneers of clinical phenomenology: Eugène Minkowski and Ludwig Binswanger. We then test, critique, and refine these hypotheses using heterophenomenological methods in an interview-based study of persons with a history of bipolar and a current diagnosis of acute mania. Jonathan Kvanvig's book, The Value of Knowledge and the Pursuit of Understanding (Kvanvig, 2003), is a wonderful example of doing epistemology in a style that Kvanvig himself has termed "value−driven epistemology." On this approach, one takes questions about epistemic value to be central to theoretical concerns, including the concern to provide an adequate account of knowledge. This approach yields the demand that theories of knowledge must provide, not just an adequate account of the nature of knowledge, but also an account (...) of the value of knowledge. Given the near−universal assumption that knowledge has a special kind of value, this demand seems reasonable, though surprisingly hard to satisfy. Another consequence of this approach to doing epistemology is that certain assumptions about epistemic value, like what sorts of things have it and what sorts of things don't, and where such value comes from, become much more salient to the epistemic enterprise. In his book, Kvanvig challenges the assumption that knowledge has some unique store of epistemic value. And he investigates the matter by asking questions about what the bearers of epistemic value are and where they get it. He concludes, of course, that knowledge as we have come to conceive it in 21st century epistemology has no such special value. (shrink)

Organizations are faced with the challenge of responding to increasing pressures to promote diversity in various ways. We draw attention to one possible proactive organizational response—the incorporation of diversity in organizational identity. This initial response necessarily evokes subsequent tasks of managing the changed identity. Therefore, this article also addresses the management of diversity identity within organizations, and relevant organizational outcomes. Our theoretical model is grounded in institutional theory, and we propose that the management of diversity identity can impact both perceptions (...) of legitimacy as well as diversity identity. Adequate, inadequate, and optimal management of diversity identity have differential effects on legitimacy and diversity identity. We contribute to the literature by a) unbundling initial and later firm responses to promoting diversity at the organizational level, and b) offering a more nuanced understanding of the complexities of managing diversity identity within organizations. We found much to agree with and it is striking how so many of the issues relating to decision-making capacity assessment find resonances outside of an English jurisdiction. This chapter focuses on the pop‐cultural significance of “Wayne's World” by taking it broadly to include not just the SNL sketches but also the movies and various special appearances. In their way, Wayne Campbell and Garth (Dana Carvey) symbolize the importance of play, leisure, and fun in our lives, and in this respect touch on certain important (...) aspects of applied philosophy, specifically the philosophy of play. Activities that are playful or leisurely have intrinsic value, and are intrinsically motivated, which means that they are done for fun, or, “for their own sake.” One of the great twentieth‐century philosophers who champions the lazier, more leisurely side of life is Bertrand Russell. In their grasshopperly way, Wayne and Garth illustrate nicely John Huizinga's theory of play. (shrink)

It groups Kant's philosophy together with those of the British empiricists--Locke, Berkeley, and Hume--in a single line of psychologistic succession and offers a clear explanation of how Kant's psychologism differs from psychology and idealism. The book reconciles Kant's philosophy with subsequent developments in science and mathematics, including post-Fregean mathematical logic, non-Euclidean geometry, and both relativity and quantum theory. In lieu of an abstract, here is a brief excerpt of the content:Ethics & the Environment 7.1 (2002) 124-137 [Access article in PDF] Katz's Problematic Dualism and Its "Seismic" Effects on His Theory Wayne Ouderkirk There is much to admire in Eric Katz's Nature as Subject. 1 Many aspects of his theory strongly resonate with dominant themes in environmental ethics and with my own theoretical predilections. In addition, he applies his theory to several major environmental issues (ecological restoration and (...) the Amazon rainforest, to name two), simultaneously testing it against other views and tracing out its implications. Impressive, non-ivory tower philosophizing. The array of issues he covers is impressive too, from the place of animal rights in an environmental ethic to the relation between environmental destruction and genocide; from the tension between holism and the rights of individuals to intrinsic value; from anthropo- centrism to Judaism and the environment; from the history of environmental thought to the convergence hypothesis. And more.In light of this tremendous range and of my own attraction to such of his major themes as ecocentrism, it might seem unappreciative to criticize, [End Page 124] to dissent. But despite all the positives I find in Katz's writings, I also find faults there, faults which, when pressed, cause major fissures in the whole. The central, major problem is Katz's dualism; and I think it ultimately undoes his whole theory, since it is so intimately connected with the other parts. Within Katz's own essays, there are, I think, resources to begin a reconstruction; but as with any other such effort, the first task is to discard the parts that are no longer useable. Before doing so, however, I want to review some positive aspects of Katz's theory, lest I convey the mistaken impression that my initial praise for his work is mere courtesy. The Solid Geological Features To begin with the most general: Katz's concern for, commitment to the natural world is obvious to any reader. He suffuses every essay with a determination to seek out clear and cogent philosophical rationales for its protection. More important perhaps is his obvious personal connection to that world. His references to Fire Island's deer and beaches, for example, amply demonstrate what the rest of his writings imply: that his theoretical efforts are more than armchair musings about a current philosophical issue. Katz's efforts are both professional and passionate.On a more specifically philosophical level, I regard his anti-anthropocentrism as a significant strength. Though one can, of course, be an anthropocentrist and be an environmental philosopher—Bryan Norton (1984) and Eugene Hargrove (1989) come to mind—I think Katz's arguments showing that anthropocentric views can only offer contingent justifications for protecting the environment are cogent and valid (3-11). An important part of those arguments is Katz's demonstration that different theories in environmental philosophy do indeed result in different environmental policies. In other words, Katz offers a strong counterargument to Norton's convergence hypothesis (Norton 1991), the idea that, given environmentalists' shared commitment to the environment, the various philosophical theories offered in justification of that commitment will converge on similar policy recommendations (149 ff.). I agree with Katz's refutation of that hypothesis, and I offer my critique of his theory because I think that theory's faults will ultimately undermine sound policies.Another big asset of Katz's theory is his communitarianism, the idea that we are part of an ecological community, an ecosystem, to which we have moral obligations. Not surprisingly to anyone familiar with environmental ethics, the source of this idea is Aldo Leopold's Land Ethic (Leopold 1966), [End Page 125] which has been debated, analyzed, praised, and critiqued more than extensively in the literature. Katz pretends to no originality here; he simply adopts and vigorously defends an ecocentric ethic that counts the integrity, stability, and beauty of the system—including, not incidentally, abiotic components—as central criteria limiting human interference with nature. This book posits that a sustainable future is possible without abandoning Capitalism. In its present form as Consumer Capitalism, the organization of the global economy is clearly unsustainable. But Capitalism is a malleable concept that has assumed a variety of forms since the 17th Century, and it can be altered as needed. In Part I of this book, Wayne Henry sets out an economic model for a sustainable form of Capitalism, referred to in the literature as Natural Capitalism. In (...) Part II, he abandons exposition in favour of rigorous philosophical analysis and critiques the older but still dominant narrative that underlies Classical Liberalism. The narrative will be reconstructed with great care and analyzed to understand why it has been so powerful and enduring, and, of course, why it is no longer appropriate for our present circumstances. In Part III, he investigates Classical Liberalism and globalized capitalism, the economic system it licenses, from a normative perspective.
